Acceptance of Terms
These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and ph38 ("ph38," "we," "us," or "our"), the operator of the online gaming platform accessible at ph38.app. By accessing, registering on, or using any part of the ph38 platform, you unconditionally accept and agree to be bound by these Terms in their entirety.
If you do not agree with any provision of these Terms, you must immediately cease using the ph38 platform and close your account if one has been created. Continued use of ph38 following any update to these Terms constitutes your acceptance of the revised Terms.
These Terms should be read in conjunction with the ph38 Privacy Policy and Responsible Gaming Policy, both of which are incorporated herein by reference and form part of the overall agreement between you and ph38.
Important: These Terms are written in English. In the event of any inconsistency between an English version and any translated version, the English version shall prevail.

Eligibility
Access to and use of the ph38 platform is subject to the following eligibility requirements, all of which must be satisfied at the time of registration and maintained throughout your use of the platform:
- You must be at least twenty-one (21) years of age. ph38 strictly enforces the minimum age requirement in accordance with Philippine gaming regulations. Providing false information about your age constitutes a material breach of these Terms.
- You must be physically located in the Republic of the Philippines at the time of accessing and using the ph38 platform, unless otherwise permitted under applicable law.
- You must not be a person who has been self-excluded from ph38 or any other gaming platform under a self-exclusion program, or who has been excluded by court order or regulatory directive.
- You must have full legal capacity to enter into a binding contract under Philippine law. Persons under legal disability or guardianship are not eligible to register.
- You must not be an employee, director, officer, agent, or contractor of ph38, or an immediate family member of any such person, unless ph38 has provided explicit written consent.
- You must not be a person whose access to online gaming platforms has been restricted or prohibited by any applicable law, regulation, or court order.
ph38 reserves the right to request documentary proof of eligibility at any time. Failure to provide satisfactory proof within a reasonable period may result in account suspension or closure and forfeiture of any pending withdrawals pending investigation.

Account Registration
To access the full range of ph38 services, you must create a registered account. The following conditions apply to account registration and maintenance:
- One Account Per Person: Each individual may hold only one (1) ph38 account. Creating multiple accounts — whether under the same or different identities — is strictly prohibited and will result in immediate account closure and forfeiture of all balances.
- Accurate Information: You must provide accurate, complete, and current information during registration, including your legal name, date of birth, Philippine mobile number, and email address. ph
38 reserves the right to verify this information through KYC (Know Your Customer) procedures at any time.
- KYC Verification: ph38 may require you to submit government-issued identification (e.g., Philippine passport, SSS ID, PhilSys National ID, driver's license, or UMID) and proof of address before processing withdrawals or upon reaching certain transaction thresholds.
- Non-Transferability: Your ph38 account is personal to you and may not be transferred, sold, gifted, or otherwise assigned to any other person under any circumstances.
- Account Currency: All ph38 accounts are denominated in Philippine Peso (PHP / ₱). Transactions are processed in PHP unless otherwise specified.
Note: ph38 complies with Anti-Money Laundering Act (AMLA) requirements under Philippine law. All accounts are subject to transaction monitoring, and suspicious activity will be reported to the appropriate authorities.

Account Security
You are solely responsible for maintaining the confidentiality and security of your ph38 account credentials, including your username, password, and any two-factor authentication codes. The following obligations apply:
- You must not share your login credentials with any other person, including family members or friends.
- You must use a strong, unique password for your ph38 account and update it regularly.
- You must notify ph38 immediately upon becoming aware of any unauthorized access to or use of your account by contacting our support team via live chat.
- ph38 will not be liable for any loss or damage arising from your failure to maintain the security of your account credentials, except where such loss results directly from ph38's own negligence or breach.
- ph38 may temporarily suspend your account if we detect unusual login activity or suspect unauthorized access, pending verification of your identity.

Deposits & Withdrawals
ph38 supports the following payment methods for deposits and withdrawals, all of which are compliant with Philippine payment regulations:
- GCash e-wallet
- PayMaya / Maya e-wallet
- Bank transfer via BPI, BDO, Metrobank, UnionBank, Landbank, PNB, or Security Bank
- Debit card (Visa/Mastercard debit, linked to a Philippine bank account)
The following additional terms apply to financial transactions on ph38:
- Minimum Deposit: The minimum deposit amount is ₱100. Minimum withdrawal amounts may vary by payment method and will be displayed at the time of withdrawal request.
- Processing Times: Deposits are generally credited instantly or within a few minutes. Withdrawal processing times vary by method and may take between one (1) and five (5) business days depending on the payment provider and KYC status of the account.
- Withdrawal to Source: Withdrawals will generally be processed back to the same payment method used for the original deposit, subject to the limits and availability of that method.
- Fees: ph38 does not charge deposit fees. Withdrawal fees, if any, will be clearly disclosed before you confirm a withdrawal request.
- Funds Ownership: You warrant that all funds deposited into your ph38 account are legally owned by you and are not derived from any illegal activity.
Prohibited Payment Methods: ph38 does not accept cryptocurrency of any kind, nor credit card deposits for gambling purposes, in compliance with current Philippine regulations. Any attempt to deposit via prohibited methods will be declined and may trigger an account review.

Bonuses & Promotions
ph38 may offer bonuses, free bets, cashback, and other promotional incentives to registered players from time to time. All bonuses and promotions are subject to the following general conditions, as well as any specific terms communicated at the time the promotion is offered:
- Bonuses are available to eligible registered players only. ph38 reserves the right to determine eligibility at its sole discretion.
- All bonuses are subject to wagering requirements, which will be clearly stated in the specific promotion terms. Bonus funds may not be withdrawn until wagering requirements have been met.
- ph38 reserves the right to modify, suspend, or withdraw any bonus or promotion at any time without prior notice, provided that any modification will not adversely affect bonuses already credited to player accounts.
- Abuse of bonuses, including but not limited to creating multiple accounts to claim bonuses, using prohibited betting patterns, or colluding with other players, will result in forfeiture of the bonus and may result in account closure.
- Bonuses have an expiry period, which will be stated in the specific promotion terms. Expired bonuses will be automatically removed from your account.

Game Rules & Fairness
All games available on the ph38 platform operate according to their respective game rules, which are accessible within each game interface. By participating in any game, you confirm that you have read and understood the applicable rules.
- All ph38 games use certified Random Number Generation (RNG) technology or live dealer mechanics, as applicable. Game outcomes are not predetermined or manipulated in favor of ph38 or any player.
- ph38 games are independently audited for fairness by third-party testing laboratories. Return-to-Player (RTP) percentages for slot games are available within the game information panels.
- In the event of a technical malfunction during a game, the affected round may be declared void and stakes returned to the player. ph38's decision on such matters is final.
- ph38 reserves the right to void any bet or game result where there is evidence of technical error, data corruption, or manipulation by any party.
- The house edge and game odds are inherent features of casino-style games. ph38 does not guarantee that any player will win or profit from playing on the platform.

Prohibited Conduct
The following conduct is strictly prohibited on the ph38 platform. Engaging in any prohibited conduct may result in immediate account suspension, permanent closure, forfeiture of balances, and referral to law enforcement authorities where appropriate:
- Registering more than one account, or registering on behalf of another person without their knowledge and consent.
- Providing false, misleading, or fraudulent information during registration or KYC verification.
- Using the platform while under the age of 21, or allowing a minor to use your account.
- Using automated software, bots, scripts, or artificial intelligence tools to interact with the platform in a manner not intended for human players.
- Engaging in any form of collusion, match-fixing, chip dumping, or coordinated play designed to gain an unfair advantage.
- Attempting to exploit software bugs, glitches, or vulnerabilities in the ph38 platform. Any discovered vulnerabilities must be reported to ph38 immediately.
- Using the ph38 platform for money laundering, terrorist financing, or any other illegal financial activity.
- Engaging in abusive, threatening, or harassing behavior toward ph38 staff or other players.
- Attempting to reverse-engineer, decompile, or otherwise tamper with the ph38 platform software.

Responsible Gaming
ph38 is committed to promoting responsible gaming and takes its duty of care to players seriously. We provide the following tools and resources to help players maintain control over their gaming activity:
- Deposit Limits: Players may set daily, weekly, or monthly deposit limits on their accounts. Once set, limits can be decreased immediately but increases require a cooling-off period.
- Session Time Reminders: Players can configure session duration reminders to alert them when they have been playing for a specified period.
- Cooling-Off Periods: Players may request a temporary suspension of their account for a defined period (e.g., 24 hours, 7 days, 30 days).
- Self-Exclusion: Players who feel they need a longer break may request self-exclusion for a minimum period of six (6) months. During self-exclusion, the account will be closed and the player will be prevented from creating a new account.

ph38 strictly enforces the 21+ age requirement. Any account found to be operated by a person under 21 years of age will be immediately closed and all funds will be handled in accordance with applicable regulations.

Intellectual Property
All content on the ph38 platform, including but not limited to software, game content, graphics, logos, trademarks, text, audio, video, and the overall look and feel of the platform, is the exclusive property of ph38 or its licensors and is protected by applicable intellectual property laws.
- You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the ph38 platform solely for your personal, non-commercial entertainment purposes.
- You may not copy, reproduce, distribute, publish, display, modify, create derivative works from, or otherwise exploit any ph38 content without prior written consent from ph38.
- The ph38 name, logo, and all related marks are trademarks of ph38. You may not use these marks without prior written permission.
- Any feedback, suggestions, or ideas you submit to ph38 regarding the platform may be used by ph38 without any obligation to compensate you.

Limitation of Liability
To the maximum extent permitted by applicable Philippine law, ph38 shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the ph38 platform, including but not limited to:
- Loss of winnings or profits resulting from technical malfunctions, service interruptions, or force majeure events.
- Unauthorized access to your account resulting from your failure to maintain the security of your credentials.
- Delays in deposit crediting or withdrawal processing caused by third-party payment providers.
- Any loss arising from your reliance on information provided on the ph38 platform that is subsequently found to be inaccurate.
- Interruption or unavailability of the ph38 platform due to maintenance, technical issues, or circumstances beyond ph38's reasonable control.
ph38's total aggregate liability to you for any claim arising out of or in connection with these Terms or your use of the platform shall not exceed the total amount deposited by you into your ph38 account in the thirty (30) days preceding the event giving rise to the claim.

Suspension & Termination
ph38 reserves the right to suspend, restrict, or permanently close any player account at its sole discretion, with or without prior notice, in the following circumstances:
- Breach of any provision of these Terms or any other ph38 policy.
- Failure to complete KYC verification within a reasonable period after being requested to do so.
- Reasonable suspicion of fraudulent activity, money laundering, or other illegal conduct.
- Receipt of a chargeback or payment dispute from a payment provider.
- Regulatory requirement or direction from a competent authority.
- Account inactivity for a continuous period of twelve (12) months or more, subject to applicable dormant account regulations.
Upon account closure, any verified balance remaining in your account (after deduction of any applicable bonus funds that have not met wagering requirements) will be returned to you via your registered payment method, subject to completion of any outstanding verification requirements.
You may close your ph38 account at any time by contacting our support team via live chat. Account closure requests will be processed within five (5) business days.

Governing Law
These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Republic of the Philippines.
Any dispute arising out of or in connection with these Terms that cannot be resolved through good-faith negotiation between the parties shall be submitted to the exclusive jurisdiction of the appropriate courts of the Republic of the Philippines.
ph38 operates in compliance with applicable Philippine gaming regulations. Players are responsible for ensuring that their use of the ph38 platform complies with all laws applicable to them in their jurisdiction.

Amendments
ph38 reserves the right to amend, update, or replace these Terms at any time. When material changes are made, ph38 will notify registered players via email or in-platform notification at least seven (7) days before the changes take effect, where practicable.
The most current version of these Terms will always be available at ph38.app/terms-conditions. The "Effective Date" at the top of this document indicates when the current version came into force.
Your continued use of the ph38 platform after the effective date of any amendment constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the platform and may request account closure.
